Terms of Service

By engaging Nexasonic for digital engineering services, software development, or by using our online portals, you agree to be bound by these comprehensive Terms of Service. If you do not accept these terms, please do not initiate work with our team.

Nexasonic provides bespoke software engineering, web application development, native mobile app creation (iOS & Android), UI/UX system design, and cloud consulting as articulated in specific project contracts and Statements of Work (SOW).

Each project engagement is governed by a dedicated Statement of Work or formal commercial proposal delineating milestone timelines, deliverable requirements, technical specifications, and budgetary schedules.

Payment schedules are specified in each project contract. Standard engagements operate on a deposit upon contract signing, milestone progress payments against sprint deliverables, and final balance release upon acceptance testing.

Upon receipt of full final payment, client receives complete ownership rights, source code repositories, design assets, and deliverable licenses. Nexasonic retains the standard right to showcase non-confidential deliverables in our agency portfolio unless explicitly precluded via written NDA.

Both parties agree to treat all business plans, financial data, and technical architectures disclosed during the project lifecycle as strictly confidential. We execute comprehensive mutual NDAs prior to in-depth technical discovery upon request.

Nexasonic’s aggregate contractual liability is strictly limited to the actual amount paid by the client for the specific service in dispute. Nexasonic will not be liable for indirect, incidental, punitive, or consequential commercial damages.

These Terms of Service and all related project contracts are interpreted and governed in accordance with the substantive laws of India. Any legal dispute or proceeding shall be subject to the exclusive jurisdiction of the competent courts in Kerala, India.
